These Terms & Conditions ("Terms") govern the use of the website oaktreepaint.com (the “Site”) and any services provided by Oak Tree Painting LLC (“Company,” “we,” “us,” or “our”). By accessing this Site, requesting an estimate, signing a services agreement, or engaging us for services, you agree to these Terms.

1. Services

Oak Tree Painting LLC provides residential and commercial painting, coating, staining, pressure washing, and related services as described in written estimates, proposals, or service agreements. All services are governed by a separate written Painting Services Agreement, which controls in the event of any conflict with these Terms.

2. Estimates & Agreements

• Estimates are not binding until accepted in writing or electronically.
• Scope, pricing, materials, and timelines are defined in the accepted estimate and services agreement.
• Any additional work requires written or electronic change‑order approval.

3. Payments & Deposits (California CSLB Compliance)

• Deposits will not exceed $1,000 or 10% of the contract price, whichever is less, in compliance with California law.
• Progress payments may be required based on project size and completion milestones.
• Final payment is due upon substantial completion and acceptance of work.
• Late balances may accrue interest at 1.5% per month if unpaid after the stated due date.

4. Cancellations

• Customers have the right to cancel within three (3) business days of signing a contract.
• If cancellation occurs after materials are ordered or work has begun, the customer is responsible for actual costs incurred.

5. Scheduling & Delays

Project schedules are estimates only. Delays may occur due to weather, material availability, site conditions, access limitations, or unforeseen circumstances. Oak Tree Painting LLC is not liable for delays beyond its reasonable control.

6. Site Conditions & Access

Customers must provide safe and reasonable access to the work area. Pets, furniture, vehicles, and valuables must be removed or protected. We are not responsible for delays or damage caused by unsafe or obstructed conditions.

7. Warranty

• A three (3) year limited workmanship warranty applies to work performed directly by Oak Tree Painting employees.
• Subcontracted work carries a six (6) month limited workmanship warranty.
• Warranty does not cover normal wear, fading, substrate failure, moisture intrusion, or work altered by others.

8. Subcontractors

We may engage licensed and insured subcontractors. Their involvement does not reduce our responsibility for project oversight or CSLB compliance.

9. Photography & Marketing​

We may photograph or record projects for documentation and marketing. No personal identifying information or exact addresses will be published. Customers may opt out in writing prior to project start.

10. Website Use

You agree not to misuse this Site, submit false information, or attempt unauthorized access. Content on this Site is owned by Oak Tree Painting LLC and may not be reproduced without permission.

11. Dispute Resolution

Disputes will first be addressed through good‑faith negotiation. If unresolved, disputes shall be handled through mediation, arbitration, or small claims court in Alameda County, California, as permitted by law.

12. Governing Law

These Terms are governed by the laws of the State of California.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Site or services constitutes acceptance of the updated Terms.
